Mr. Ellis is also often retained to be part of a litigation “team” to assist trial counsel before and immediately after judgment. These services include helping to define legal and factual issues, taking part in developing strategic and tactical objectives and related procedures, preparing jury instructions, advising on how to optimize the evidentiary record for appeal, and drafting substantive motions – before, during, and after trial – which are either dispositive of the case or could have a material impact on a subsequent appeal, whether the client be appellant or respondent.
